Orderly Estates Privacy Policy

This Privacy Policy is between you and Orderly Estates, LLC, together with its affiliates and assignees (collectively “Orderly Estates” or “We”), and provides you with details on the information we collect from you and the uses we may make of your Personal Information (“PI”). By accessing or using Orderly Estates’ web and mobile application OrderlyEstates.com (the “Site”), or by providing information in connection with the website, you agree to this Privacy Policy.

Your use of the Site will always be governed by the Privacy Policy and Terms of Use posted at the time, whether you have reviewed them or not.
The Site is not designed to collect PI; however any PI you may give us in connection with the Site is subject to this Privacy Policy.
The Site is not intended for individuals under the age of 13 and we have no intention of collecting PI from children under 13. If you are under the age of 13 or would otherwise be restricted from registering a social media account because of your age, please do not provide us with us with any PI of any kind.

No cookies are used by Orderly Estates. However we do collect visitors’ IP addresses to analyze trends, administer the Site, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

The Site contains links to other sites. Please be aware that Orderly Estates is not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave the Site and to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by OrderlyEstates.com.

Orderly Estates operations and maintenance contractors may sometimes have limited access to any PI you provide in the course of providing products or services for the Site. These contractors include vendors and suppliers that provide us with technology, services, and/or content for the operation and maintenance of the Site. Access to your PI by these contractors is limited to the information reasonably necessary for the contractor to perform its limited function for the Site.

We may disclose any PI you provide to our affiliates or subsidiaries in connection the provision of services via the Site; however, if we do so, their use and disclosure will be subject to this Privacy Policy.

In addition to disclosures that you specifically authorize, Orderly Estates may disclose PI as follows: (1) to comply with legal requirements such as a law, regulation, search warrant, subpoena or court order; (2) in response to a physical threat to you or others; (3) to protect property or to defend or assert legal rights; or (4) in connection with a transaction or proceeding involving the transfer of all or part of our business relating to the information, or involving the transfer of control of those assets involved in such business. In the event that Orderly Estates is legally compelled to disclose your PI to a third party, we will attempt to notify you, unless doing so would violate the law or court order. Any and all attempts by Orderly Estates to provide notification will be made solely by email to any email address that you provide.

The Site is maintained in the United States of America. By using the Site or submitting any information to the Site, you authorize the export of PI to the United States of America and its storage and use, as specified in this Privacy Policy.

 This Privacy Policy and our legal obligations hereunder are subject to the laws of the State of Colorado and the United States of America. Except to the extent prohibited by Federal law, the exclusive venue for any action arising out of or relating to this Privacy Policy shall be the Superior Court for the Judicial District of Denver in Denver, Colorado.

California law permits residents of California to request certain details about what PI a company shares with third parties for the third parties’ direct marketing purposes. In the event that you submit a request under this law, please submit your request to Customer Service, attn: California Privacy.
Orderly Estates may modify the terms of this Privacy Policy at any time, and if we do so we will post the changes here. The modified terms will become effective at the point they are displayed here, so we strongly recommend that you review this policy from time to time.
Orderly Estates Terms of Use

These Terms of Use ("TOU") form an agreement between you and Orderly Estates, LLC, together with its affiliates and assignees (collectively “Orderly Estates” or “We”), and govern your use of the resources and services provided through Orderly Estates’ website OrderlyEstates.com (the “Site”).
Your use of the Site will always be governed by the TOU and Privacy Policy posted at the time, whether you have reviewed them or not.
We do not provide legal services, nor does any of the information on this website constitute legal, tax, or other professional advice.  The content of the Site is strictly informational, and you use it at your own risk.  While we make a reasonable effort to maintain accurate and timely site content, we cannot guarantee it to be correct or complete.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOU.

IN NO EVENT SHALL ORDERLY ESTATES, ITS LICENSORS, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY DAMAGES (INCLUDING CONSEQUENTIAL, INCIDENTAL, SPECIAL DAMAGES OR SPECIFIC PERFORMANCE) RESULTING FROM THE USE OF OR INABILITY TO USE THE SITE WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ORDERLY ESTATES IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You acknowledge and agree that the Content used by us, as well as the photos, graphics, text and other material appearing on the Site, are protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. OrderlyEstates.com, the Orderly Estates logo, and other Orderly Estates product and service names are trademarks of Orderly Estates (the "Orderly Estates Marks"). Except as expressly authorized by Orderly Estates, you agree not to display, modify, distribute, create derivative works based on, or use in any manner, the Orderly Estates Marks or anything found on the Site.

The Site contains links to other resources, which are provided solely to assist visitors in locating those resources. Orderly Estates does not necessarily endorse, and is not responsible for, any third party content that may be accessed through the Site. Any third party websites which link to the Site are not under our control and no endorsement is implied by such linkage.

Our Contact Us form is solely for informational, support or feedback purposes.  Do not send confidential information via this form, as we cannot guarantee its secure transmission.  If you are an existing client and you communicate with us by email, you should note that the security of email is uncertain. By sending sensitive or confidential email messages that are not encrypted, you accept the risks of such possible lack of confidentiality.
The TOU and Privacy Policy constitute the entire agreement between you and Orderly Estates, and govern your use of the Site, superseding any prior agreements between you and Orderly Estates. The TOU and the relationship between you and Orderly Estates shall be governed by the laws of the State of Colorado without regard to its conflict of law provisions. Except to the extent prohibited by Federal law, the exclusive venue for any action arising based on the use of the Site or this agreement shall be the Superior Court for the Judicial District of Denver in Denver, Colorado. The failure of Orderly Estates to exercise or enforce any right or provision of the TOU shall not constitute a waiver of such right or provision. If any provision of the TOU is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOU remain in full force and effect.
